Content & Intellectual Property Policy
Last updated: October 24, 2026
KustomPop prints and embroiders artwork that customers upload. This policy explains what we will not produce and how rights holders can report infringement. It is part of our Terms.
1. Only upload what you have the right to use
Upload only logos, images, names and text that you own or have permission to use. Common examples we cannot produce without proof of permission: sports team, university, brand or franchise logos; cartoon, movie, game or other characters; celebrity names or photos; artwork, fonts or photos copied from the internet; and other businesses' logos. We may ask you for proof of permission before producing an order.
2. Content we do not produce
We will not produce content that:
- infringes a copyright, trademark, right of publicity or other right of someone else;
- is illegal, or promotes illegal activity, violence or terrorism;
- is hateful or harasses people based on race, ethnicity, national origin, religion, sex, sexual orientation, gender identity, disability or similar characteristics;
- is sexually explicit, or sexualizes minors in any way;
- threatens, harasses, defames or reveals private information about a real person;
- is false or misleading in a way that could cause harm (for example fake licenses, fake official or government insignia, or fake certifications);
- our production partners will not produce.
We review orders in good faith and may refuse or cancel an order under our Terms. Declining or cancelling one order is not an approval of other content.
3. Reporting infringement (DMCA notice)
If you believe content on our site or a product made by us infringes your copyright, send a written notice to our designated agent with:
- your physical or electronic signature;
- identification of the copyrighted work you claim is infringed;
- identification of the material you claim is infringing and information reasonably sufficient for us to locate it (for example a link or order details if you have them);
- your name, address, telephone number and email;
- a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law;
- a statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or authorized to act for the owner.
Designated agent: Luiz Carlos da Silva Junior, Silva Growth LLC (KustomPop), 201 Windsor Ridge Dr, Westborough, MA 01581, United States · legal@kustompop.com · +1 (508) 816-8635. Registered with the US Copyright Office DMCA Designated Agent Directory (Silva Growth LLC, registration DMCA-1084055).
For trademark or other complaints that are not copyright, write to the same address with the details of your right and the content involved.
4. Counter-notice
If your content was removed because of a notice and you believe it was a mistake or misidentification, you may send a counter-notice to our designated agent with: your signature; identification of the material removed and where it appeared; a statement under penalty of perjury that you have a good-faith belief it was removed by mistake or misidentification; your name, address and phone; and a statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the US, any district where we may be found) and will accept service from the person who sent the notice. We may restore the material in 10 to 14 business days unless the complaining party tells us it has filed a court action.
5. Repeat infringers
We will refuse service and close the accounts of customers who repeatedly upload infringing content.
6. False reports
Knowingly false notices or counter-notices can lead to liability for damages under 17 U.S.C. § 512(f).
